Privacy Policy

Your photos, formulas, and client records belong to you. This policy explains what we collect, how we use it, and the controls you have.

1. Introduction

This Privacy Policy explains how Haircolor AI ("Haircolor AI," "we," "us," or "our") collects, uses, discloses, and protects information when you use the Haircolor AI mobile application and related services (the "Service"). By using the Service, you agree to the practices described in this policy. If you do not agree, please do not use the Service.

The Service is designed for professional colorists and stylists who use it to read hair color, generate and store formulas, and keep records of their clients' color history.

2. Information We Collect

We collect the following categories of information:

  • Account information. When you create an account, we may collect your name, email address, and authentication details.
  • Subscription and purchase information. Subscriptions are processed by Apple through your Apple ID. We receive confirmation of your subscription status and transaction identifiers, but we do not receive or store your full payment card details.
  • Content you provide. This includes photos you take or upload (such as before-and-after images of hair), color formulas, client names or labels, notes, appointment details, and other information you enter to maintain your records.
  • Usage and device information. We may collect information about how you use the Service, your device type, operating system, app version, and diagnostic or crash data to operate and improve the Service.

3. Client Information and Your Responsibilities

The Service allows you, as a professional, to store information and photographs relating to your clients. You are responsible for obtaining any consent required from your clients before capturing, uploading, or storing their photographs or personal information in the Service, and for handling that information in accordance with applicable laws.

You should only collect and store client information that you are authorized to process, and you should obtain client consent before using any client photographs for marketing or public sharing.

4. How We Use Information

We use the information we collect to:

  • Provide, maintain, and improve the Service, including AI color analysis and formula generation.
  • Save your formulas, photos, client timelines, galleries, and scheduling so they are available to you across your use of the Service.
  • Process and manage your subscription and provide customer support.
  • Monitor and analyze usage, diagnose technical issues, and protect the security and integrity of the Service.
  • Communicate with you about updates, security notices, and support requests.

5. AI Processing and Third-Party AI Provider

When you use the AI color read feature, the photo you select and any related text you provide (such as your description of the goal or target result) are transmitted off your device to OpenAI, our third-party artificial intelligence provider, for processing. OpenAI uses this data to estimate the hair's level and tone and to generate a suggested formula, which is returned to the app.

We send this data only when you actively use the AI color read feature. Before your first AI color read, the app presents an in-app consent prompt that explains that your selected photo and text will be sent to OpenAI for processing, and you must agree before any data is transmitted. If you do not consent, the AI color read feature is not used and no photo or text is sent to OpenAI.

We have a data processing arrangement with OpenAI under which:

  • No training on your data. Your photos and text submitted through the API are not used by OpenAI to train or improve its models.
  • Limited retention. OpenAI retains the data submitted for AI color reads for a limited period (currently up to approximately 30 days) for the purpose of providing the service and for abuse monitoring, after which it is deleted, except where a longer period is required by law.
  • Purpose limitation. The data is used only to deliver the AI color read you requested and is not used for OpenAI's own independent purposes.

AI suggestions are provided as a starting point for a qualified professional and should always be confirmed by your own judgment and testing.

6. How We Share Information

We do not sell your personal information. We may share information only in the following limited circumstances:

  • Service providers. With vendors who perform services on our behalf, such as cloud hosting, analytics, and crash reporting, under obligations to protect the information.
  • AI provider. When you use the AI color read feature, we share the photo and related text you submit with OpenAI, our third-party AI provider, solely to generate your color reading and formula, as described in the "AI Processing and Third-Party AI Provider" section above.
  • App platform. With Apple, as necessary to process subscriptions and operate the app on its platform.
  • Legal and safety. When required by law, regulation, legal process, or to protect the rights, property, or safety of Haircolor AI, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

7. Data Security

We use reasonable technical and organizational measures, including per-user access controls, to protect your information from unauthorized access, loss, or misuse. Only you are intended to have access to your own client records within the Service. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. You may delete content within the app, and you may request deletion of your account and associated data as described below.

Photos and text sent to OpenAI for AI color reads are subject to OpenAI's limited retention (currently up to approximately 30 days, as described in the "AI Processing and Third-Party AI Provider" section), and are not used to train OpenAI's models.

9. Your Choices and Rights

Depending on your location, you may have rights to access, correct, delete, or restrict the processing of your personal information, and to request a copy of it. To exercise these rights, or to request deletion of your account, contact us at info@jhobbie.com. You can also manage your subscription at any time in your Apple ID account settings.

10. Children's Privacy

The Service is intended for professional use by adults and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

11. International Users

We may process and store information in countries other than where you live. Where we transfer information, we take steps to ensure it remains protected consistent with this policy and applicable law.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised policy.
